Buying A Property Check For These Legal Documents

Planning to buy a property? Before buying an apartment or house, you need to check documents carefully. Knowing more about these documents will help you master the entire house or land purchase process. Likewise, it is vital to legally follow the right path when investing in future assets.

The following is a list of documents required  for buying a property:

Title Deed

Make sure that the land is in the name of the person who sold you the property and that he also has the right to sell the property without the consent of any other person. Obtain the original deed checked by the lawyer for legal confirmation You can also request verification of previous land deeds Before registering, please make sure you obtain the release certificates of all other partners who own the land.

Encumbrance certificate

Encumbrance certificate states that the property does not have any encumbrances or loans. This is an important document for obtaining a loan for property from a bank. It has all the details of the transaction related to the property.

Housing plan approval 

It is important to ensure that the place where your property is located has been approved and that the building plan must also be verified. You should also check whether any building rules are violated. The architectural planning and layout should comply with the National Building Code of India.  The layout must also comply with GRIHA (Green Rating for Integrated Habitat Assessment).

Agricultural to non-agricultural land conversion certificate

It is important to note that the land you are buying is not agricultural land. Any land designated as agricultural land shall not be used for residential purposes, otherwise, it will be considered illegal. Therefore, if you have reason to believe that the land you purchased was once an agricultural property, please make sure to provide you with a conversion certificate issued by the corresponding revenue authorities. A conversion certificate is required to change the purpose of land use from agriculture to non-agricultural. The urban planning department of the relevant city needs to issue a no-objection certificate for agricultural land for non-agricultural purposes.

Land use certificate of the property

It is illegal to construct property for residential purposes in a commercial area.You need to apply to the development department of your respective city to verify whether the residential property you intend to buy is in a residential area, not in a commercial, agricultural or industrial area. Without the approval of the competent urban development department, no residential property may be purchased for commercial purposes.


No Objection Certificate

It is important to require developers to produce copies of various NOCs, these copies must be procured from various departments such as the Sewage Treatment board, Pollution Control board, Environmental Department, Transportation and Coordination Department.

Commencement Certificate

This certificate is essential to start any property construction. This is issued by the town planning department after carefully checking the layout, floor plan, superstructure, etc. of the building. The builder should take all necessary sanctions before embarking on construction.

Receipt of property tax

The property tax receipt held is that the previous owner or occupier has paid all taxes and there is no remaining tax payable. They also establish the legal status of the property and therefore are important evidence documents.

Sale Deed

The sale deed is one of the most important legal documents. There is evidence that the property has been sold and ownership of the property has been transferred from the seller to the buyer. Before executing the sale deed, all expenses such as property taxes, utility bills, maintenance and housing society fees should be paid. Attention should be paid to the fact that it is mandatory to register the sale deed.

Khata certificate and Khata extract

Khata is derived from the word "account". It is the account of the person who owns the property. It usually consists of (a) Kata certificate and (b) Kata extract. The registration of new property and the transfer of property must be compulsory to provide Kata certificate. Khata Extract is nothing more than obtaining property details from the appraisal registry. It is needed when purchasing and obtaining a trading license.

This document proves that the property has been recorded in the local municipal records and construction has been carried out in accordance with the approved plan. The bank requires this document before offering you a homeloan.

Occupation certificate

After the building is constructed, the municipal corporation will issue an occupancy certificate or completion certificate to prove that the building was constructed according to the approved plan and can be used at any time.
